Small claims case against Liena and Ben

In an odd turn of events, a source for a couple of blog posts is being sued along with Liena and Ben for "defamation" and "loss of scholarship" in small claims court. I have not seen the details of the case but I am interested in why my source would be sued by an ex-roommate and also named in a suit with the Smiths. In fact, my source received a letter from Judge Judy, informing her that she was being sued. Kind of funny. I will be following this one closely as maybe I can use some of the information for my own case.

    from an email from Eloise 4/2/10 "I plan on filing a civil lawsuit against him so unfortunately for you, it won't be on "Judge Judy." I have already spoken to an attorney who thinks I have a very good case as he has seen this type of stuff before."

    relating a community blog to the KKK is much akin to tea bagger's labeling Obama and his policies as Hitler and Nazism. It is severely inconsiderate of those who actually suffered under evil entities.

    As to the picture, I won't argue with your statement about Yeshiva's credibility. However that doesn't undermine that the DPB linked to the picture (which is pertinent) and not the Yeshiva World News article or any of their standpoints.

    This is akin to posting pictures and giving credit to the kkk news. And speaking of Obama and Hitler, the Yeshiva World News has been link to groups in Israel who think that obama is the greatest threat to jews since Hitler.     As far as the kkk is concern, I was watching an interview with Bob Costas and Ice Cube in the 90's at the height of gangsta rap. Costas made a very great point about some of the worst parts of gansta rap. He said that if a kkk racist wanted to show black people in the worst possible way with the worst possible images and let it be accepted by mainstream society, they could not find a better friend then some of the gangsta rap that was out there. Well the kkk don't need gangsta rap anymore. They could not find a better friend then the Ditmas Park blog now. Their posting is akin to a virtual lynch mob.

  7. Sorry but your argument is invalid.

    The picture posted on the Yeshiva News website and reposted on the DPB does neither condemn nor condone any behavior. It is merely a photo of current events in our neighborhood. As a neighborhood blog, it is their imperitive to provide as much information on nearby happenings in order to keep us, as a community, well informed.

    Again, your concluding statement "their posting is akin to a virtual lynch mob" is insulting to anyone who has suffered under oppression.

  8. The idea that you can have a link to a website and not endorse it's behavior is the most absurd thing I've heard. So is it ok for CNN to link to a picture from kkk.com or killalljews.com and not condemn or condon the content of the website? Secondly the blog is called the ditmas park blog and the picture is a picture of an incedent that did not occur in ditmas park. As far as them having "us" as a community well inform, how good of a job are they doing when you yourself has admitted that you don't know too much about the police sodomy case that happened just a few blocks from ditmas park. Are they really trying to keep the community aware? Or do they already have a preconceived idea of what the black communty is? This is the same tactic that fox news has been using, got us into 2 wars and trillions of dollors wasted. If ben "racism does not exist" Smith and his ilk at the msm was as vigelent in his wall to wall coverage of every minor event that is happening in the black community as they were not doing the build up of the iraq war, mortgage scams, ponzi scams, wall street crime and halliburton backroom deals maybe the world would be a better place. But I'm not holding my breath.

  9. You bring up a very good argument. One I have to agree with in a vacuum. I agree that linking to a site does support and does not condone the website’s motivations. However, I do think there is a significant difference between an ultra-right wing Zionistic movement, who certainly has an agenda, with a group of people who actively seek ot and murder those they discriminate against. So while I agree that linking to Yeshiva News is at least a slightly more than neutral stance on the issue, it’s not as severe as linking to a hate group with a previous record of criminal behavior.

    That being said, you raise an interesting ethical dilemma that plagues journalism. What is more important, the source or the material? Imagine for example, that somehow (and I’m aware this would never happen but for the sake of an argument) that a national disaster occurred, and that none of the predominant news agency’s were able to attain any footage or information about the event. Would they, or you for that matter, be willing to accept documentation if it came from a source with a controversial agenda? As in the shooting incident, the organization that submits the situation that is documented would not support their agenda in any form, but instead merely pass along the information. Still, would should this information be received, and how.

    Personally, I’m mixed on the situation. We are not informed on all the details, nor are we always informed where our news comes from (something that is severely worrisome). My thoughts are if somehow, as is possible (but I’m unsure how likely) Yeshiva News is the only source available, and the information they provide does not actively condone illicit behavior, than I think it’s fair game to share that information as long as a disclaimer about where the documentation came from is added, as was the situation on the DPB. And this action should not reflect poorly on the news or blog organization. However, if there are multiple sources with equally compelling information, than the choice to use one source over another most certainly reflects on the news or blog organization.

    Unfortunately, I do not know the details of this situation. And I am not going to assume either way.

    I think a lot of the tension between the DPB and their naysayers comes from the misunderstanding that all the information on the blog is original and generated internally. Much of it, as is certainly the case with the 70th precinct notifications, the information is handed to them, and they simply repost it.

    And now a quick story:
    A friend of mine has a blog. She is white, young, Jewish, and lives in the neighbourhood. She had sent a link to the DPB hoping they would add a link on their tool bar. They declined. She never found out the reason. Still, if Ben and Liena have an agenda, it certainly isn’t to support only white Jews as is often argued on this blog.

    Again, thanks for responding in a well thought out argument. I enjoy these discussions and hope to learn from then. I at least hope that they provide thought provoking debates, as it did here. Have a good day.

  10. A letter from Judge Judy? Wow. When did judges assume the role of Process Servers?

    The crazy claim of another suit is a phony as the claim about the deranged Eloise suing the operators of the Ditmas Park Blog.

    As always, cases filed in NY are accessible online. Therefore it is easy to know the truth.
